Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Hum ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Hum is developed and operated by Winton Gee ("we," "our," or "us"). The App is a native iOS app that plays synthesized, generative sound for sleep and focus.

2. Eligibility

You must be at least 13 years of age to use Hum. By using the App, you represent and warrant that you meet this age requirement.

3. App Requirements

  • iOS 17.0 or later is required
  • iPhone device (the App is not optimized for iPad)

4. Free Tier and Subscription Plans

Free Tier

The free version of Hum lets you preview any locked sound for 60 seconds before playback pauses and you're offered the option to subscribe.

Hum Premium

Hum Premium unlocks unlimited playback of every sound in both Sleep and Study modes. Premium is sold as a single subscription option:

  • Yearly Subscription: $19.99 per year (price may vary by region), with a 7-day free trial for new subscribers

Subscription Terms

  • Subscriptions are managed through the Apple App Store
  • Payment will be charged to your Apple ID account at confirmation of purchase, at the end of the free trial if not canceled first
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • You can manage and cancel subscriptions in your App Store account settings
  • No refunds will be provided for partial subscription periods; refund requests are handled by Apple

5. Not Medical Advice

Hum is a sound and relaxation app. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, sleep disorder, or medical condition. Hum makes no health claims. If you have a sleep disorder or medical concern, consult a qualified healthcare professional.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • The App will meet your specific requirements
  • The App will improve your sleep, focus, or any health outcome
  • Defects will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WINTON GEE OR HUM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of use of the App
  • Any damages arising from your use or inability to use the App

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

8. Apple App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App Store.

Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.

9. Intellectual Property

The App, including its design, features, and content, is owned by Winton Gee and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to disclaimers, limitations of liability, and intellectual property provisions.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
